Terms & Conditions

These Terms and Conditions outline the rules and regulations for the use of our services. By engaging with Balderston Associates, LLC, you accept and agree to be bound by the following terms and conditions.

  1. Scope of Services

    Balderston Associates, LLC provides third-party verification services for green building projects. Our role is to verify that specific criteria and standards have been met according to the guidelines of the relevant certification programs. However, it is important to note that:

    • No Guarantee of Certification: While we conduct thorough verifications, the final decision regarding certification lies with the certifying body. Balderston Associates, LLC does not and cannot guarantee the certification of any structure or project.

  2. Tax Credits, Rebates, and Refunds

    Balderston Associates, LLC is not a tax firm and does not employ tax professionals. Certain green building projects may be eligible for tax credits, rebates, or refunds and we provide assistance with verification services that may contribute to the application and submittal for these. However, Balderston Associates, LLC:

    • No Guarantee: Does not guarantee approval or provision of any tax-related benefits, incentives, or refunds.

    • Consultation Recommendation: Strongly advises clients to consult with a qualified tax professional regarding any questions or considerations related to tax rebates, credits, or refunds associated with their project.

  3. Code Compliance

    Balderston Associates, LLC’s services are limited to green building verification and do not include code enforcement or consultation of code requirements. Therefore:

    • No Code Enforcement: Balderston Associates, LLC is not an enforcement agency for city, state, or federal building codes.

    • No Code Advice: We do not provide advice or recommendations on building codes. Clients are encouraged to consult with licensed professionals or local code officials for any code-related concerns.

  4. Scheduling of Meetings and Inspections

    To ensure that we can meet the needs of our clients effectively, Balderston Associates, LLC has established the following policies for scheduling:

    • Minimum Lead Time: Clients must submit requests for meetings or inspections with a minimum lead time of 10 calendar days. This allows us sufficient time to coordinate and prepare for the requested service.

    • Less Than 10 Days' Notice: If a request is made with less than 10 days’ notice, Balderston Associates, LLC cannot guarantee that we will meet the requested deadlines. Efforts will be made to accommodate such requests, but availability cannot be assured.

  5. Cancellations and Rescheduling

    Balderston Associates, LLC understands that schedules can change. However, to manage our time effectively and serve all clients efficiently, the following cancellation and rescheduling policies apply:

    • Notice Requirement: Clients must provide a minimum of 48 business hours' notice to cancel or reschedule a scheduled on-site inspection or meeting (whether virtual or in-person).

    • Failure to Provide Notice: If the required notice is not provided, the client may be charged the full hourly fee for the originally booked time slot.

    • Missed Appointments: Missed appointments without notice may result in charges that include the originally scheduled hourly fee, plus any applicable travel time and expenses.

  6. New Project Proposals

    Balderston Associates, LLC strives to provide timely and accurate proposals for new projects. The following guidelines apply to proposal requests:

    • Submission Requirements: New Project Proposal Requests must be submitted via www.balderstonassociates.com/newproject and must be accompanied by a current plan set emailed to kate@balderstonassociates.com.

    • Proposal Timeline: For proposal requests submitted by Thursday at 3 PM PST, Balderston Associates, LLC will make every effort to provide a proposal by the following Wednesday at 3 PM PST. If this timeline cannot be met, the requestor will be notified.

  7. Limitation of Liability

    Balderston Associates, LLC’s liability is limited to the verification services provided. We are not responsible for any indirect, incidental, special, or consequential damages arising out of or in connection with our services.

  8. Amendments

    Balderston Associates, LLC reserves the right to modify or amend these Terms and Conditions at any time. Clients will be notified of any significant changes.

  9. Governing Law

    These Terms and Conditions are governed by and construed in accordance with the laws of the State of Washington.
